Absolutely — informed consent says that the individual has had the opportunity to ask questions of a medical professional — a transplant consultant isn’t getting a job in a hospital as a transplant consultant unless there’s some sort of medical background — no doctor on the face of the Earth would do that.

A patient isn’t conned into surgery — he/she ALWAYS has the opportunity to say no — it isn’t a . . . come here, sign this, let me chop you up . . . thing.

More importantly — if there was a day lapse between the time the consent was signed and the time the surgery was performed — then he had the opportunity to weigh the pros and cons of the surgery . . . and his claim wouldn’t stand half a chance.
